US Judge Orders Freedom of Abrego Garcia from ICE Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.
"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation originates in a erroneous removal to El Salvador in March, which US authorities later admitted was an error. After his return to the United States to answer human smuggling allegations, he was held in immigration detention.
In her order, the court noted that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
